1. Service description

FleetLeave is a PTO and absence management application for logistics and transportation companies, providing web and mobile access for submitting, approving, and tracking employee time-off requests, along with related PTO balance, accrual, coverage, and reporting functionality. FleetLeave is currently offered as an early-access product; features and availability may change as the product develops.

2. Account responsibilities

Customers are responsible for the accuracy of the organization, employee, and policy data they enter into FleetLeave, and for maintaining the confidentiality of login credentials issued to their users. Customers are responsible for promptly deactivating access for employees who leave the organization.

3. Acceptable use

FleetLeave may not be used to store data you do not have the right to store, to attempt unauthorized access to any part of the system, to interfere with the service's normal operation, or for any unlawful purpose.

4. Customer data

Data a customer enters into FleetLeave — employee records, PTO requests, balances, and related information — remains the customer's data. We access it only as necessary to operate the service, provide support, or as required by law.

5. Availability

We aim to keep FleetLeave available and reliable, but we do not currently offer a formal uptime service-level agreement. Planned maintenance and any material service issues will be communicated to customers where practical.

6. Intellectual property

FleetLeave, including its software, design, and branding, is the property of its operator. These terms do not grant customers any ownership interest in the underlying software — only a right to use it as described in a customer's agreement with us.

7. Confidentiality

Each party agrees to protect the other's confidential information with the same degree of care it uses for its own confidential information, and not to disclose it except as needed to perform under these terms or as required by law.

8. Limitation of liability

To the maximum extent permitted by law, FleetLeave's operator will not be liable for indirect, incidental, or consequential damages arising from use of the service. This section will be finalized with counsel as part of a formal customer agreement.

9. Termination

Either party may terminate service as described in a customer's specific agreement with us. Upon termination, customers may request an export of their data within a reasonable period.

10. Governing law

These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles, and any dispute arising from them will be resolved in the state or federal courts located in Delaware.
